All sales that are made through the Adorables Preloved Marketplace (here on out referred to as “the website”) are final.
1.1.1.
Once the payment has been made by the buyer, a mutual agreement has formed between the seller and buyer and, in turn, finalising the sale.
1.1.2.
If for some reason you would like to reverse the transaction, such actions can only be done once the sale through the website has been completed and the funds have been released to the buyer.
1.1.3.
Therefore the reversal of the transaction shall be dealt with privately and not through Adorables Preloved
1.2.
An item will not be able to immediately be withdrawn from the website.
1.2.1.
A notice or application for removal will need to be made to the admin of the website in order for an item to be removed.
1.2.2.
Such an application will take up to 48 hours to confirm.
1.3.
All sales done through the website will have 20% of the final sale price go to Adorables Preloved as commission.
1.4.
The sale of an item cannot be guaranteed by Adorables Preloved nor can an estimated time be given of how quickly an item will be sold.
1.4.1.
The success of the sale is determined by what type of item has been listed, its value versus price as well as the demand for a specific item at the time.
1.5.
All items being listed on the website must be cleaned and refurbished to the best of the seller's own ability in order to be presented as ‘new’.
1.5.1.
It should be expected that the item is in good working order.
1.5.2.
All electronic items being sold need to be in working order. It will be expected of the seller to prove to Adorables Preloved that the item works by means of video proof.
1.6.
All posts made on the website must not be misleading and must be in line with Section 41(1) of the Consumer Protection Act 68 of 2008 which states as follow:
1.6.1.
In relation to the marketing of any goods or services, the supplier must not, by words or conduct
1.6.1.1.
(a) directly or indirectly express or imply a false, misleading or deceptive representation concerning a material fact to a consumer;
1.6.1.2.
(b) use exaggeration, innuendo or ambiguity as to a material fact, or fail to disclose a material fact if that failure amounts to a deception; or
1.6.1.3.
(c) fail to correct an apparent misapprehension on the part of a consumer, amounting to a false, misleading or deceptive representation, or permit or require any other person to do so on behalf of the supplier
2. PURCHASING CONDITIONS
2.1.
You are responsible for reading the full item listing before making a bid or offer, buying, or committing to buy.
2.2.
You enter into a legally binding contract to purchase an item when you buy, commit to buying an item or your offer for an item is accepted.
3. PAYMENTS AND DELIVERY
3.1.
The seller will be responsible for ensuring the item sold finds its way to the buyer. This includes all courier fees and arrangements as well as all other related expenses to the transfer of ownership of the items sold.
3.2.
Payment to the seller shall not be made until the item has been received by the buyer.
3.2.1.
The website will take the liberty of holding the money paid out by the buyer and only upon delivery and confirmation thereof will the money be released by the website to the seller.
3.3.
The asking price of each item shall be calculated in a way that is fair and upholds the purpose of the website, that being to allow a buyer to purchase a high-quality second-hand item at a more affordable price than in stores.
